Yes. If your car is leaking petroleum based fluids, such fluids can destroy the pavement and become a source of contamination of everybody’s environment. Your car then becomes a good candidate to be towed away from Island Creek premises.
If your car starts leaking fluids, please clean it up and place something under the car to absorb those fluids and to protect the pavement until you can get your car repaired.
All cars in Island Creek must be in compliance with State and Local car registration requirements (for the State where your car is registered).
Your car is your responsibility. This means your car must be inspected and have current tags, plates and current stickers and decals. Otherwise, your car can be towed (after being given notice) if it is not in compliance with the law.
Yes. Island Creek (like Fairfax County) considers a car abandoned if it sits in an open parking space without moving for at least 10 days.
If you have a car that you do not use, please consider getting rid of it or park it on a public street nearby (Thomas Grant and John Thomas Drives (townhome side only) or Morning View Dr.
If your are going to be out of town for a period of time greater then 7 days, it is a good idea to notify Island Creek Community Manager at iccaonsite@sequoiamanagement.com, so that your car will not be towed.
Parking spaces in Island Creek are at a premium. Please be considerate of your neighbors and do not “take over” or monopolize free parking spaces.
The towing company number is also listed on signs posted throughout the Community.
The towing company reports any vehicles they tow to the police. You may call the police non-emergency number at 703-691-2131 to determine whether your car was towed. If the police do not know about your missing vehicle, then something more nefarious may have happened to it.
If trash pick up service is cancelled, Bates will notify the community manager early in the morning and it will be then posted on the Island Creek web site.
When there is not certainty, please do not put your trash out! Visit the BATESweb site for latest information from our contractor.
However, sometimes if conditions are hazardous, the contractor may decide at the last minute to cancel our trash collection.
If our contractor cancels the pick up service, they will not come out again until the next regularly scheduled pick up day.
First and most important to keep good relationships with your neighbors: "Don't place your trash/recycle/any trash on front of your neighbor's houses."
Trash & garbage containers are not permitted in public view earlier than dusk the evening before pickup and all containers must be removed from public view no later than dusk the day of pickup.
Trash can put out your the day before pickup at night (when it is dark) or the day of pickup before 6:00 am.

No, you cannot. Paint is considered hazardous waste and must be disposed of at a County Disposal and Recycling Center (I-66 Transfer Station or I-95 Landfill).
The contractor will not collect any paint cans or trash bags with paint cans.
You can't hide it in the trash! After your garbage is collected, the truck compacts it. If your trash contains any paint , it will spray out everywhere leading to your residence and you will be charged for removing the paint from the street and/or sidewalk.
Paint that you can wash up with water is not considered to be hazardous waste. You can let it dry out, and the dispose it elsewhere; because the trash contractors will still not collect them!.
Paint that you have to clean up with mineral spirits (Paint Thinner, Turpentine, etc.) is considered hazardouswaste and you must dispose of it at the local landfill (Fairfax County hazardous trashdisposal).
Make sure to include your address & if can/bin is damaged send picture. If personal bin is damaged, please email pictures/video (if possible) & explanation of what happened so we can send it to our safety department.

Rinse the items thoroughly to remove all foodstuffs.

Place all items together in the bin. You do not have to short recyclables. Everything goes in the bin, mixed together.
Place paper goods (Newspaper/magazines/mixed paper) next to the bins in separate brown paper bags or tied with twine.
Large cardboard should be cut to less than three feet square in size, flattened & placed in or next to the recycling bin container (making sure these pieces cannot blow away).
Make sure that light items are at the bottom of the bin so that they do not become airborne.
Put the recycling bin at the curb outside your home next to your trash, every Friday.
Household garbage should be placed in a trashcan or a brown or black bag and tied securely. This helps discourage scavenging animals from tearing into the bags and scattering trash around the neighborhood.
BATES Trucking and Trash Removal services does not provide free trash or recycling containers. You may purchase one from them by calling 301-773-2069 or you may purchase your own from a retail store.
You should take it back onto your property if possible, and then determine why it was not collected. The trash is your responsibility until the issue is resolved. Trash must be out by 6AM on the day of pickup; they won't come back around if you are late putting it out.
If you cannot determine why your trash was not removed, call the contractor directly.

VDOT maintains Morning View, John Thomas (on townhouse side) and Thomas Grant (townhouse side) only. As a reminder, VDOT does not get to secondary roads quickly, as their main focus during storms is to clear major roads and highways.
Island Creek contracts for snow removal on all other neighborhood streets (the Condo Streets are handled by a separate company). The Association does not clear or treat the common area sidewalks as the expense would be too costly. It is asked that each owner shovel and treat the sidewalk in front of their homes.
It is best to shovel the snow from your parking spot and sidewalks to the front of your space or to shovel/dump the snow to a grassy yard or common area. In the major snow event several years ago, residents who dumped snow in the street, not only caused a major safety concern, but cost the association and ultimately the homeowners a lot more money, as the snow had to be moved with a loader since it freezes and makes an ice mound! Creating long furrowed rows of snow beyond the parking spaces reduces the width of cleared roadways and eliminates the primary objective of creating two lanes of traffic. It also makes the snow turn into hard ice mounds, which makes it difficult for the snow plow to remove.
Our Declaration was found to have outdated language and needs to be updated to ensure that townhomes that do not have a garage or driveway will continue to have reserved parking spaces. Parking issues have caused several cases to be brought to court in the Commonwealth of Virginia including White v. Boundary Association, Inc. (2006) and Manchester Oaks HOA v. Batt (2012). Failure to update our Declaration could result in future litigation which would negatively impact every homeowner financially. In order for the declaration to be amended to preserve the reserved parking spaces, we need 75% of all unit owners to sign and turn in the Declaration Ratification Form.
● We want to continue with the status quo (2 assigned spots per non-garage townhouse, as it has been for 25+ years) and maintain property values
● If someone were to sue the Association over a parking issue, it could cost the community over $500,000 in legal fees alone, in which we all would have to pay our part
● Lawsuits must be declared in any Resale Packet – giving potential buyers a reason to pass on the sale of your home
● If not updated, any parking enforcement will be very difficult (i.e. — residents in surrounding communities could park in IC spaces for extended periods of time)
● The sooner we get to 781, the sooner we will stop having to reach out to you with reminders :)
It is for these reasons that we need every homeowner in our Community (single family, condominiums, and all townhomes) to return their form as this affects all of us.
There are a total of 1041 units in Island Creek. 102 single-family, 332 condo, and 667 townhouses (414 with garages and driveways, 193 without garages or driveways). We would need 75% of the lots (781) to vote in favor. And each lot could have multiple signatures.
You should have already received the ratification form via mail along with a letter, and a copy of 2024 budget. Please follow the directions on the form for who needs to sign, please make sure each signature is witnessed, and return the form using the instructions on the letter.

No. The form must be physically signed. These forms will be recorded with the land records which require wet physical signatures. photocopies, E-signed copies, or other alternatives are not permitted.
You can be a witness to everybody. However, it is not advised for spouses or other owners listed on the form to witness each other’s signatures since that could be challenged in court.

The Landsdowne amendment only provided one parking space to non-garage owners. The Island Creek Community Association amendment keeps the status quo in that it preserves the 2 reserved parking spaces for non-garage townhouse owners. There are not enough parking spaces for everyone in the community to have one assigned space. All other spaces, whether in private land-bays or in private streets are first-come-first-served to all owners. It is also recommended the board has the authority to designate visitor’s spaces.
We’ve gone for this long without a lawsuit. Someone could run to the courthouse and file a lawsuit tomorrow and could cause the entire community to go to first-come-first-served. However, the court could see that since the Board and the community is working on it, they could provide leniency and set a deadline on the completion. A reasonable deadline for the Board to work on this is one year from the upcoming annual election, September 2024, with some flexibility to extend depending on the status of how far along they are in the process. And if that fails, the community will go to first-come-first-served.
